I. General data protection information


1. Portraits - recordings and use

(1 ) We provide you with the following information in the event that we make recordings of you and subsequently distribute and/or publicly display them. This includes, among other things, the storage and, if necessary, modification of the images as well as other processing activities. In the following, we refer to this as the use of images. In accordance with the requirements of the EU General Data Protection Regulation (EU GDPR), we hereby inform you in accordance with the legal requirements of Art. 12 and 13 EU GDPR. 6. image database
We enter your image and, if applicable, your other data in our image database, which we use for documentation and as an archive in addition to organizing our data for our own purposes. Your data will remain stored there for as long as your consent, our agreement or our legitimate interest justifies this.


7. Disclosure of images to third parties
Your images and any other personal data will only be disclosed to third parties if you have consented to this, if an agreement with you permits this or if our legitimate interest justifies this. Your personal data will be transmitted to third parties for the purposes of public relations and advertising as part of our tasks to promote tourism and location marketing. For this purpose, your image will also be passed on to third parties, in particular press and media representatives, cooperation and sales partners from business and the public sector, regional associations and tourist offices. Your personal data will not be passed on to third parties for purposes other than those mentioned.

II Specific data protection information


1. Use of images with legitimate interest

(a) We make recordings of events and scenes from public events and our own events in which you may be depicted as a person. We use the recordings for public relations work and advertising measures in print and online media, in particular for press releases, as a review and to promote subsequent events as well as on our website and our social media channels. We also use the recordings to document our own work for internal purposes. In some cases, we will also state your name when using the image. However, this is only ever the case if it is necessary for the image to be understood and you appear in the image in a specific way (e.g. in the case of public figures in the context of an event of public interest).

(b) We do not take photographs unexpectedly, but make separate reference to the possibility of taking photographs in the specific situations and in our invitations. We always select the recordings that cause the least disturbance to you and prefer recordings in which people are only depicted as accessories. At these events, especially if they represent a historical event, our interest in documentation and our public relations work outweighs your interest in not being photographed.

(c) Data processing is carried out in accordance with Art. 6 para. 1 sentence 1 lit. f EU GDPR because we have a legitimate interest in public relations work for our own events and public events.

(d) The images are used by us for the duration of the communication measures and then deleted. We regularly check our image database to ensure that it is up to date.


2. Use of images on a contractual basis (agreement)

(a) If we have entered into an agreement with you regarding the use of your image, we will process the following personal data from you in order to implement this agreement:

Title, first name, surname

E-mail address and postal address

Telephone number (landline and/or mobile for queries)

Date of birth, if applicable (for the purpose of age verification)

Portrait

(b) This data is collected

to be able to identify you as the rights holder and data subject;

for correspondence with you;

for contractual processing;

to use your image in accordance with our agreement.

(c) Data processing is carried out in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR because you have entered into an agreement with us regarding the use of your image.

(d ) The personal data processed by us for the execution of the contract will be deleted at the end of the contractual authorization of use. In addition, we process your data to the extent and for as long as we need it to secure proof of our contractual agreement until the expiry of the statutory or agreed limitation rules. In this case, our legitimate interest in securing our legal claims and objections pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR serves as the legal basis.


3. Use of pictures with consent

(a) As part of your consent to the use of your image, we process the following personal data from you:

Title, first name, surname

E-mail address and postal address

Telephone number (landline and/or mobile for queries)

Date of birth, if applicable (for the purpose of age verification)

Portrait

(b) This data is collected

to be able to identify you as the rights holder and data subject;

for correspondence with you;

to use your likeness in accordance with your consent.

(c) Data processing is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a and Art. 7 GDPR because you have given us your consent to use your likeness.

(d ) The personal data processed by us for the use of the image will be deleted for the duration of the consent or in the event of your withdrawal of consent. In addition, we process your data to the extent and for as long as we need it to secure proof of consent until the expiry of the statutory or agreed limitation rules. In this case, our legitimate interest in securing our legal claims and objections pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR serves as the legal basis.

(e) If you withdraw your consent, we will of course immediately cease or restrict the processing of your personal data for the future.

III Rights as a data subject

(a) You can

in accordance with Art. 15 EU GDPR information,

rectification pursuant to Art. 16 EU GDPR ,

pursuant to Art. 17 EU GDPR erasure,

restriction of processing pursuant to Art. 18 EU GDPR and

to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller in accordance with Art. 20 GDPR and

to lodge a complaint with a supervisory authority in accordance with Art. 77 EU GDPR.

(b) If you have given your consent, you can revoke it at any time without giving reasons in accordance with Art. 7 III GDPR.

(c) In the case of the use of data for legitimate interests, you can object to data processing in accordance with Art. 21 EU GDPR if there are reasons arising from your particular situation.
